Gensail reserves the right to modify, suspend, or discontinue the Services (or any part thereof) at any time without liability.

If any Services are offered for a fee, you agree to pay in accordance with our pricing and billing terms. We reserve the right to change fees with advance notice.
Unpaid invoices may incur finance charges, and you are responsible for all applicable taxes other than Gensail’s net income taxes.
The Services and related software, features, and content are owned by Gensail and its licensors. You may not copy, distribute, modify, or reverse-engineer them without authorization.
The Gensail name and logo are trademarks of Gensail LLC. All rights not expressly granted are reserved.
You retain ownership of any content you upload, but you grant Gensail a worldwide, royalty-free, sublicensable license to use such content solely to provide and improve the Services.
The Services may contain links or integrations with third-party websites or services. Gensail is not responsible for their content, availability, or practices.
We may suspend or terminate your account or access to the Services at any time, with or without cause, including for inactivity or violations of these Terms.
You may also terminate your account at any time by discontinuing use of the Services.
You agree to indemnify, defend, and hold harmless Gensail LLC and its officers, employees, and agents from claims, damages, losses, or expenses (including legal fees) arising out of your use of the Services or violation of these Terms.
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” Gensail DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not guarantee uninterrupted, error-free, or secure operation of the Services.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Gensail WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES.
Our total liability to you will not exceed the greater of $100 or the amount paid by you to Gensail in the six (6) months prior to the claim.
All disputes between you and Gensail arising out of these Terms or the Services will be resolved through binding arbitration under the rules of the American Arbitration Association (AAA).
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
